MIAMI - A federal judge yesterday said Manuel Noriega is a prisoner of
war and should not serve his 40-year sentence in a civilian penitentiary.
But the judge said he may not have the authority to enforce his opinion.

U.S.  District Judge William Hoeveler said he isn't sure he has the
jurisdiction to enforce the Geneva Convention, which governs treatment of
POWs.  He said he will issue a ruling within a week on the defense request
that Noriega be assigned to a military facility.

In April, Noriega was convicted of eight drug and racketeering counts
for accepting bribes to protect the Panamanian operations of Colombia's
Medellin cocaine cartel.  In July, he received a 40-year sentence.  He is
in a holding cell in the federal courthouse in Miami.
