The Bill passed House Judiciary last Wednesday, (see Zhao Haiqing's report). The current situation is this: The bill was NOT sent to the whole House for action. It is in the House Rules Committee waiting to be scheduled. However, at 12:00 noon, the Rules Committee has not taken actions on the bill because to do so, the Rules Comm. has to receive a request from the Judiciary Comm. for actions on the bill. The Judiciary Comm. has not sent that request yet. The Rules Comm. is only responsible for setting a date for the bill to be picked up by the whole House and the ways in which it will be debated. 2. SHOULD WE CALL JUDICIARY COMMITTEE? Definitely YES. But change the tactics. A. Ask the Judiciary Comm. to send request to Rules Comm. to take actions on the Bill. B. Call individual members of the Judiciary Committee. They are also members of the House. So they will vote again when the bill comes to the whole House. Ask them to support the bill and oppose any IRRELEVANT amendments. (Also thank them for supporting the bill in the Judiciary Comm.) 3. CAN WE LOBBY RULES COMMITTEE Yes, but be careful. The Rules Comm. serves as a secretary to the whole House. The bill will not stay long in this Committee. An email posting to China-net in last week prematurely urged lobbying the Rules Comm. Offices in that Committee have shown resentment against premature lobby efforts. Right now when the lobby should focus on the Rules Comm., calls to that Comm. would be inpatiently answered. The Rules Comm. staffs asked us to pass the words around: "Congress will not sent Chinese students /nationals back to China." Any way, we should defend our interests. But please be polite and thankful to the staffs when you make the calls. 4. CLOSED RULE OR OPEN RULE Two different opinions have emerged in the net, one wants CLOSED RULE, another wants OPEN RULE. We want CLOSED RULE. CLOSED RULE would prevent further amendments to the bill. About the changes in the House, they would help the bill pass the White House, according to our discussion with Congressional members this morning. The changes were proposed by INS and the Judiciary Department, therefore, President is not likely to veto a bill which has amendments from his administration. We have requested the Judiciary Comm. version of the bill and will post it as soon as we receive it. [The following are excerpted from IFCSS HQ Special Report 4014. - Editor] 5. THE NUMBER OF THE BILL: The bill now considered by the House is INDEED S1216. It was passed by the Senate and sent to the House for consent, so it keeps its original number indicating that it is originated in the Senate. The House has its own bill which has not been picked up. 6. THE HATIAN AMENDMENT: The Hatian amendment proposed by Michigan Congressman Conyers has been rejected by the Chair of House Judiciary Committee on the ground that it is not germane (which means IRREELEVANT to the protection of Chinese students). So it will not cause any trouble in the Judiciary Committee. However, when the bill comes to the House floor, the amendment may still be proposed. There are two chances to defeat that amendment: A. When the bill comes to the Rules Committee, the committee makes it a CLOSED BILL which cannot accept amendments. B. If it remains open and when it is raised in the whole House, it may be ruled NOT GERMANE and thus be rejected. 7. WHAT TO SAY TO CONGRESSMEN: This should be divided into two levels: Individual and institutional. Indi- vidually, the message should be very brief and simple. One sentence is enough. To the Congressmen, express your concern and ask for support. Congressmen receive tens or hundreds calls a day on a certain issue, they do not remember who said what. They just keep a record of how many messages received on a bill and how many support and how many oppose the bill. On this level, the NUMBER of calls is the key. Institutionally, local schools or groups may send formal petition letters to Cogressional offices. A sample letter will be posted later. 8. COME TO D.C. TO LOBBY? There is no such a need at this time. But be prepared. When the House receives the bill, we will call for lobby groups to come to D.C. 9. WILL PRESIDENT BUSH VETO IT? Unlikely. First, the administration cannot prove that it is safe for Chinese students to return to China. (The State Department has been criti- cizing the human rights records of the Chinese government.) Second, the President cannot withdraw protection and send the students back to China. Third, the United States has been heraled as the "land of the free and asylum of the oppressed." United States has given Permanent Residency to peoples from several countries in the past after Presidential protection orders are expired. The president must have strong arguments to reverse such a tradition. Fourth, it is a presidential election year. Bush would prefer to avoid public controversy. According to sources from Congressional staffs, President Bush has indi- cated in an occasion that he will sign the bill if it is passed by Congress. (Not confirmed through other sources.) We are optimistic. But we have do our best to support the bill. We should not relax until the bill is signed into law. ---------------------------------------------------------------------------- 3. Recent Trend of Greater China Fund.................................... 32 ---------------------------------------------------------------------------- From: Huangxin Wang and Deming Tang, 7-24 Since July 20 (Tuesday) PaineWebber's Greater China Fund stock went public and exchanges on the New York Stock Exchange (NYSE listing: GCH). This fund is largely to be invested in the two stock markets in China. You can get the info about it from PaineWebber: 1-800-458-1764. I find it very interesting in the bulletin that this American capitalist money maker (PaineWebber is the fifth largest investment firm on Wall Street) sings praises of the "Five Star Flag". Anyway, this free brochure contains some very valuable information about China's economy and worth a simple phone call to ask for one. The stock price can be found daily on New York Times, or just call PaineWebber. At the begining, the stock is $15 each. But today it drops to $13.75. I guess it may due to the lack of demand, or people are really wary of China. My personal feeling is if one considers in long term, this discouraging begining may not hurt since we are not to speculate on the stock price fructuation. It is now well known that the international students and their dependents at Penn State are fighting against the university, yet it is not well known, or at least not well agreed upon, why there is such a battle. The reason is simple: Penn State signed the contract with MEGA for fiscal year 1992-1993, perhaps by mistake, but nobody will pickup the bill at a time of severe recession; so whoever signed it are greatly hurt, trying to get money in whatever way they can find including taking the hard-earned money from international students. Mok, 7-28 After graduating high school with honor, Andrew Yuen, 18, of Seabrook, Maryland, was to begin his studies at the University of Maryland when he was diagnosed with leukemia last September. He spent 4 months at the George Washington University Hospital for chemotherapy treatment and appeared to be on the way to recovery. However, a further blood test in June showed that the leukemia has recurred. Andrew desperately needs a bone marrow donor to donate bone marrow to him. However, to date, doctors have failed to find a perfect match for Andrew among his family, relatives, or from within the Naitonal Marrow Donor Registry. Andrew's family has been beset with misfortunes. His grandfather and grandmother passed away within the last 6 years. His father, Chok-You, died of liver cancer in 1984 at the age of 48. Andrew was one of 3 chil- dren being raised single-handedly by his mother, Man-Kei. This is an appeal to all to volunteer to test for the correct bone marrow type. The appeal also goes out especially to people of Asian-Pacific ori- gins, since the chances for finding a perfect match greatly increase if the donor and the patient are of the same race. A bone marrow drive targeting the Asian community in the Washington area will be held from 12:30 pm to 3:30 pm September 27, at the Chinese Bible Church of Maryland, 4414 Muncas- ter Mill Road, Rockville, Md.
